Particularităţile sarcinii probei în litigiile de contencios administrativ

This article aims to identify the particularities that affect the burden of proof in disputes judged according to the rules governed by the Administrative Litigation Law no. 554/2004, in correspondence with the analysis of the legislator’s will regarding the mentioned institution which, over time, during the civil process, granted the public authorities, in the disputes concerning public officials, an atypical position compared to the civil cases judged adversarially with other categories of employees.

Thus, the article comes to analyze the applicability of the current provisions of art. 12 and art. 13 of the Administrative Litigation Law in comparison with the regulations specific to labor conflicts, as well as the sanctions that may be imposed on the public authority/institution summoned to court, in case of non-compliance with the legal provision in question.

Prezentul articol are în vedere identifi carea particularităţilor sarcinii probei în litigiile judecate potrivit regulilor guvernate de Legea contenciosului administrativ nr. 554/2004, în corespondenţă cu analiza voinţei legiuitorului în privinţa instituţiei amintite care, de-a lungul timpului, în cursul procesului civil, a acordat autorităţilor publice, în litigiile privind funcţionari publici, o poziţie atipică faţă de dosarele civile judecate în contradictoriu cu alte categorii de angajaţi. Astfel, articolul vine să analizeze aplicabilitatea prevederilor actuale ale art. 12
și art. 13 din Legea contenciosului administrativ nr. 554/2004 în comparaţie cu reglementările specifice conflictelor de muncă, precum și sancţiunile pe care le pot suporta autorităţile/instituţiile publice chemate în judecată, în cazul nerespectării dispoziţiei legale în cauză.
