ABSTRACT
This article contains two important sections. The first refers to the Judgment of the Court of Justice of the European Union dated April 3, 2025, delivered in Case C-431/23, WIBRA BELGIE SA, which concerns the interpretation of Article 5(1) of Council Directive 2001/23/EC of March 12, 2001 on the approximation of the laws of the Member States relating to the safeguarding of employees’ rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses.
The second part addresses the protection of employees’ rights in the event of a transfer of an undertaking, a business unit, or parts thereof, under national law, specifically the relevant provisions of the Labour Code and related legislation.

REZUMAT
Prezentul articol are în conţinutul său două părţi importante. Prima se referă la Hotărârea Curţii de Justiţie a Uniunii Europene din 3 aprilie 2025, pronunţată în cauza C-431/23/ WIBRA BELGIE SA, care face referire la interpretarea art. 5 alin. (1) din Directiva nr. 2001/23/CE a Consiliului din 12 martie 2021 privind apropierea legislaţiilor statelor membre referitoare la menţinerea drepturilor lucrătorilor în cazul transferului de întreprindere, unităţi sau părţi de întreprindere sau unităţi.
A doua parte privește protecţia drepturilor salariaţilor în cazul transferului întreprinderii, al unei unităţi sau al unor părţi ale acestuia, conform dreptului naţional, mai precis a dispoziţiilor în materie din Codul muncii și din acte normative conexe.
