Noi reglementări privind calitatea de drept comun a Codului muncii

The Labor Code contains several provisions that establish it as the common law in
the fi eld of employment legal relationships. It applies not only to relationships arising from individual employment contracts – covering employees and their employers – but also to other employment relationships that are not based on such contracts, deriving instead from special regulations.

Thus, the application of the Labor Code extends in certain areas to other categories of employees/workers (such as public servants, including those with special status, military personnel, magistrates etc.) as well as to employers, including public authorities and institutions.

This article specifically examines the amendments to the Labor Code introduced by Law No. 283/2024, presented and explained in an original manner.

Codul muncii conţine mai multe dispoziţii care conferă calitatea de drept comun
în materia raporturilor juridice de muncă. El se aplică nu doar raporturilor izvorâte din contractul individual de muncă, deci salariaţilor și angajatorilor lor, ci și altor raporturi juridice de muncă care nu au ca temei un atare contract, izvorul lor constând în reglementări speciale. Se extinde astfel aplicarea Codului muncii, în anumite materii și asupra altor categorii de angajaţi/lucrători (funcţionari publici, inclusiv cu statut special, militari, magistraţii etc.), precum și angajatorilor – autorităţi și instituţii publice. Articolul de faţă privește, în special, modificările aduse Codului muncii prin Legea nr. 283/2024, prezentate și explicate într-o manieră originală.
