Încheierea Contractului Colectiv de Muncă la nivel de unitate

The article aims to highlight the conventional nature of the conclusion of a collective agreement.

At the basis of the creation of a collective agreement is the freedom of will of the parties (employer and employees/workers in the unit, group of units, collective bargaining sectors, up to national level), as a consequence of the principle of freedom of negotiation.

The only limitation on the parties in negotiating the terms of the collective agreement is compliance with the law.

This article will refer to the conclusion of the collective agreement at the lowest level, i.e. unit level.

The purpose of concluding a collective labour agreement is to ensure the security of employees/workers, a balanced working climate, the establishment of labour relations, the rights and obligations of the employer and employees in the establishment where they work, the prevention and limitation of collective labour disputes.

Articolul are în vedere să evidenţieze caracterul convenţional al încheierii unui contract colectiv de muncă.

La baza creării unui contract colectiv de muncă se afl ă libertatea de voinţă a părţilor (angajatorul și salariaţii/lucrătorii din unitate, grup de unităţi, sectoare de negociere colectivă, până la nivel naţional), ca o consecinţă a principiului libertăţii de negociere.

Singura limitare a părţilor în negocierea clauzelor contractului colectiv de muncă este respectarea legislaţiei.

Prezentul articol va face referire la încheierea contractului colectiv de muncă la nivelul cel mai mic, respectiv la nivel de unitate.

Scopul încheierii unui contract colectiv de muncă este asigurarea securităţii salariaţilor/lucrătorilor, a unui climat echilibrat de lucru, stabilirea raporturilor de muncă, a drepturile și obligaţiilor ce revin angajatorului și salariaţilor din cadrul unităţii unde își desfășoară activitatea, prevenirea și limitarea confl ictelor colective de muncă.
