Dreptul la muncă al persoanelor majore cu dizabilităţi psihosociale și intelectuale din perspectiva evoluţiei contextului socio-juridic și al modificărilor legislative intervenite prin Legea nr. 140/2022

This study aims to highlight the legislative evolution in the field of equal protection and recognition before the law of persons with disabilities. Historically, in the legal systems worldwide, people with disabilities stand out among all the groups that have been arbitrarily and prejudicially denied the right to full legal capacity. Not all forms of disability cause changes in legal capacity, but only psychosocial and intellectual disabilities. People with disabilities are recognized as having the right to work under conditions of equality with others. Therefore the legislative reconfiguration of the civil law mechanisms for the protection of the vulnerable person of age was a necessary measure to align the national regulations with the international standards in this field.

Prezentul studiu își propune să evidenţieze evoluţia legislativă în domeniul protecţiei și recunoașterii egale în faţa legii a persoanelor cu dizabilităţi. Istoric, în sistemele juridice la nivel mondial, se remarcă, dintre toate grupurile cărora le-a fost îngrădit arbitrar și prejudicial dreptul la capacitate juridică completă, persoanele cu dizabilităţi. Nu toate formele de dizabilităţi determină modificări ale capacităţii juridice, ci doar dizabilităţile psihosociale și intelectuale. Persoanelor cu dizabilităţi le este recunoscut dreptul de a munci în condiţii de egalitate cu ceilalţi. Astfel că reconfigurarea legislativă a mecanismelor de drept civil de ocrotire a persoanei majore și vulnerabile a fost o măsură necesară pentru alinierea reglementărilor naţionale la standardele internaţionale din acest domeniu.
