Consideraţii generale privind reglementarea muncii la domiciliu în administraţia publică din România prin Codul administrativ

The administrative code adopted recently by GEO no. 57/2019, provides, finally, as a novelty for the Romanian public administration, the possibility of working at home only for the staff employed under a contract and not for the civil officers, as it is necessary to make a distinction between these who, are rather located in a „grey area”.

The economics of the text of law refers to the common law regulations in the matter (S.108-S. 110 of the Labour Code), but „omits” or, more precisely, does not expressly provide that it may include in its sphere the telework; it is understood, at the same time, that the specificity of the individual employment contract of general nature from the public sphere must also be taken into account.

In this material, we want to capture the overall picture of novelty in the matter.

Codul administrativ adoptat relativ recent prin O.U.G. nr. 57/2019, prevede, în sfârşit, cu caracter de noutate pentru administraţia publică din România posibilitatea muncii la domiciliu doar pentru personalul contractual nu şi pentru funcţionarii publici, necesară fiind distincţia între aceştia care, mai degrabă, se situează într-o „zonă gri”.

Economia textului de lege trimite la reglementările de drept comun în materie (art. 108 – art. 110 C. muncii), însă „omite” ori, mai exact, nu prevede expres că aceasta poate cuprinde în sfera sa şi telemunca; se înţelege, totodată, că trebuie avut în vedere şi specificul contractului individual de muncă cu caracter general din sfera publică.
