Munca suplimentară

An exception from the normal work schedule (40 hours per week) is additional work.

This is possible only as an exception and under strictly determined conditions. Thus, the maximum legal duration of working time cannot exceed 48 hours per week. The extension of this duration is possible, but provided that the average working hours, recorded over a reference period of four calendar months (sometimes six months), does not exceed 48 hours.

Additional work is possible only at the initiative of the employer and, as a rule, with the worker’s agreement.

Another rule is that the extra work must be compensated by free hours paid in the next 60 days after its completion, and when the compensation is not possible, a salary increase will be granted.

O excepţie de la programul normal de lucru (de 40 de ore pe săptămână), o reprezintă munca suplimentară.

Aceasta este posibilă doar ca excepţie şi în condiţii strict determinate. Astfel, durata maximă legală a timpului de muncă nu poate depăşi 48 de ore pe săptămână. Prelungirea acestei durate este posibilă, dar cu condiţia ca media orelor de muncă, înregistrată pe o perioadă de referinţă de 4 luni calendaristice (uneori de şase luni) să nu depăşească 48 de ore.

Munca suplimentară este posibilă doar la iniţiativa angajatorului şi, ca regulă, cu acordul lucrătorului.

O altă regulă constă în aceea că munca suplimentară trebuie compensată prin ore libere plătite în următoarele 60 de zile după efectuarea acesteia, iar atunci când compensarea nu este posibilă se va acorda un spor la salariu.
