Asistenţa şi protecţia consulară oferită cetăţenilor europeni prin intermediul misiunilor diplomatice/oficiilor consulare ale României

The theme chosen for the article is a topical one, on which many opinions have been formulated by many specialists, but in practice there are still questions that have not found the answers. I mention that in the studied literature I have found studies undergoing systematic researches to highlight the issues addressed: Consular assistance and protection offered to European citizens through diplomatic missions/consular offices of Romania.

The choice of theme was not accidental. As a legal adviser within the Ministry of Foreign Affairs, the Consular Department was given the opportunity to participate repeatedly at meetings that had as a central issue the provision of assistance and consular protection to persons with European citizenship.

Throughout the work, we have tried to address the main aspects of providing European citizens with consular assistance and protection, starting from the notion of consular assistance and protection to consular procedures.

The conclusions of this article are those that result from the analysis of the aspects related to the studied elements, but also found in the specialized literature in the field of diplomatic and consular law.

Tema aleasă pentru realizarea articolului este una de actualitate, asupra căreia s-au formulat numeroase opinii de către foarte mulţi specialişti, însă în practică încă mai există întrebări care nu şi-au găsit răspunsurile. Precizez că în literatura de specialitate studiată am găsit studii supuse unor cercetări sistematice care să evidenţieze problematica abordată şi anume: Asistenţa şi protecţia consulară oferită cetăţenilor europeni prin intermediul misiunilor diplomatice/oficiile consulare ale României.

Alegerea temei nu a fost întâmplătoare. În calitatea mea de consilier juridic în cadrul Ministerul Afacerilor Externe, Departamentul Consular am fost pusă în situaţia de a participa în repetate rânduri la reuniuni care aveau ca subiect central acordarea asistenţei şi protecţiei consulare persoanelor care au cetăţenia europeană.

Pe parcursul întregii lucrări am încercat să ating aspectele principale ale acordării asistenţei şi protecţiei consulare cetăţenilor europeni plecând de la noţiunea de asistenţă şi protecţie consulară până la procedurile consulare.

Concluziile acestui articol sunt cele ce rezultă din analiza aspectelor legate de elementele studiate, dar şi regăsite în literatura de specialitate în domeniul dreptului diplomatic şi consular.
